Member’s Mall

Article 1 (Purpose)

The Terms and Conditions seek to define the rights, obligations, and responsibilities of the Member's Mall (hereinafter referred to as "Member's Mall") operated by AUTON Co., Ltd. (an electronic trading company, hereinafter referred to as "the Company") and the user in utilizing Genesis Member's Mall.

Article 2 (Definitions)

1. ① "Genesis Membership" (hereinafter referred to as "Membership") means a customer service program wherein various benefits are offered by Hyundai Motor for Genesis customers.
2. ② "Member's Mall" refers to a virtual shop set up by “the Company” so that goods or services can be traded using information and communication facilities such as computers, etc. to provide customers with goods or services. It is also used as a means of Cyber Mall Operator.
3. ③ "Customer" means a member who accesses the "Member's Mall" and orders goods or services provided by online shopping malls in accordance with these Terms and Conditions.
4. ④ "Member" means a person who provides personal information to Hyundai Motors by registering as a member and who can continue to use the services provided by “Genesis and Member's Mall.” Note, however, that the "Member's Mall" shall not establish its own membership registration or withdrawal process but uses the information related to "Customers" provided by Hyundai Motors.
5. ⑤ “Entrepreneur" means a company that has contracted with "the Company" in order to supply "Goods, etc." to the "Customer" via the "Member's Mall.” If the "Customer" purchases the "goods, etc." of the "Entrepreneur" through the "Member's Mall," it is the party to the purchase agreement and the party responsible for delivery, refund, etc. of goods, etc.

Article 3 (Specification and Explanations and Amendments of Terms)

1. ① The “Member's Mall” shall post the contents of the Terms and Conditions, company name, representative's name, office address (including the address where consumer complaints can be handled), telephone number, fax number, e-mail address, business entity registration number, communication sales business report number, etc. on the initial service screen (front side) for easy reference by the "Customer." Note, however, that the contents of the Terms and Conditions can be browsed by the “Customer” through the connection screen.
2. ② Before the customer agrees to the terms, the “Member's Mall” provides a separate connection screen or a pop-up screen so that customers can understand important content such as subscription withdrawal, responsibility of delivery, refund conditions, etc. defined in the terms and conditions.
3. ③ The "Member's Mall" may amend the Terms and Conditions to the extent that such amendment does not violate the relevant laws and regulations such as Act on Consumer Protection in Electronic Commerce, Act on the Regulation of Terms and Conditions, Framework Act on Electronic Documents and Transactions, Act on the Promotion of Information and Communications Network Utilization and Information Protection, etc., Act on Door-to-door Sales, Etc., Act on Consumer Protection, etc.
4. ④ If the “Member's Mall” amends the Terms and Conditions, the date of application and reasons for revision shall be specified and displayed on the initial screen of the “Member's Mall” 7 days prior to the application date along with the current Terms and Conditions. If the terms of the agreement are amended in a manner disadvantageous to the "Customer," at least 30 days' prior notice will be given. In this case, the "Member's Mall" shall clearly show the contents before and after the revision so that the "Customer" can understand it clearly.
5. ⑤ If the "Member's Mall" amends the terms, the amended Terms and Conditions shall apply only to contracts concluded after the effective date. For those contracts that have already been concluded before the effective date, the terms of the pre-revision terms shall apply. If a "Customer" who has already entered into the contract agrees to be subject to the provisions of the revised terms, however, the revised terms shall be applied when he / she agrees through the "Member's Mall" within the notice period of the terms revision under Clause 4.
6. ⑥ Matters other than those set forth in this agreement as well as the interpretation of these terms and conditions shall be governed by the Act on Consumer Protection in Electronic Commerce, Act on the Regulation of Terms and Conditions, Guidelines for Consumer Protection in Electronic Commerce, and applicable or practical laws.

Section 4 (Provision and Change of Service)

1. Section 4 (Provision and Change of Service)
   1. 1) Provide information on goods and conclude a purchase contract.
   2. 2) Delivery of goods for which a purchase contract is concluded.
   3. 3) Other tasks designated by the “Member's Mall.”
2. ② The "Member's Mall" shall change the contents of the goods, etc. to be provided by future contracts when they run out of stock or technical specifications are changed, etc. In this case, the contents and provision date of the changed goods, etc. shall immediately be notified to the place where the contents of the present goods are posted.
3. ③ If the “Member's Mall" changes the contents of the service contracted with the "Customer" for reasons such as out of stock or change of technical specifications of goods, etc., the “Customer” shall immediately be notified of the reason via available contact or address.
4. ④ In the case of the foregoing clause, the "Member's Mall" shall compensate the “Customer” for any damage caused by the change. Note, however, that this does not apply if the "Member's Mall" proves that there was no intention or negligence.

Article 5 (Interruption of Service)

1. ① The "Member's Mall" may suspend the service provision in any of the following cases:
   1. 1) If unavoidable due to construction such as maintenance of service facility, etc.
   2. 2) In case the telecommunication service provider specified in the Telecommunications Business Act terminates the telecommunications services.
   3. 3) In case of any other justifiable reasons.
2. ② The "Member's Mall" may limit or suspend all or part of the services when there is any hindrance to the normal use of service due to national emergency, blackout, failure of service facilities, or excessive use of services.
3. ③ In the event that it becomes impossible to provide services due to the conversion of business items, abandonment of business, merger of companies, etc., the "Member's Mall" shall notify the "Customer" in the manner set forth in Article 9 and compensate the consumer under the conditions initially set forth by the "Member's Mall." If the "Member's Mall" has not specified the compensation standards, etc., however, compensation shall be made in kind, or cash equivalent to the points currency value of the "Customer” shall be provided.

Article 6 (Purchase Requisition)

A “Customer” who uses the “Member's Mall” shall request purchase at the “Member's Mall” by the following or similar methods, and the “Member's Mall” shall provide the following information in an easy-to-understand manner for the “Customer” making purchase requisition (if he or she is a "member," however, Articles 2 ~ 4 shall not apply):

1. 1. Search and Selection of Goods, etc.
2. 2. Entry of Name, Address, Phone Number, E-mail Address (or Mobile Phone Number)
3. 3. Confirmation of Cost-related Contents of Terms, Subscription Withdrawal Limited Services, Delivery Fees, Installation Fees, etc.
4. 4. Marks Indicating Agreement to the Terms and Conditions and to Confirm or Reject Item 3 above (Mouse Click)
5. 5. Purchase Requisition of Goods, etc. and Confirmation or Consent to Confirmation of the "Member's Mall”

Article 7 (Contract Establishment)

1. ① The "Member's Mall" may not approve the purchase requisition as described in Article 6 if it falls under any of the following:
   1. 1) If there are falsities, omissions, or typos
   2. 2) If it is judged that approving the purchase requisition poses considerable harm to the technology of the “Member's Mall”
2. ② When the consent of the "Member's Mall" reaches the "Customer" in the form of acknowledgment notification of Clause 1, Article 9, the contract is considered to have been established.
3. ③ The acceptance declaration of the "Member's Mall" should include information on the confirmation of the Customer’s purchase requisition, availability, correction and cancellation of purchase requisition, etc.

Article 8 (Payment Method)

The payment for goods, etc. purchased at the "Owner's Mall" may be made by any of the following methods:

1. 1. Payment by Hyundai Motors points
2. 2. Card payment such as debit and credit card, etc.
3. 3. Multiple payments using points and card / bank transfer

Article 9 (Acknowledgment of Receipt, Modification and Cancellation of Purchase Requisition)

1. ① The "Member's Mall" shall notify the “Customer” of acknowledgment of receipt by e-mail (or text message) if there is a purchase request from the "Customer."
2. ② The "Customer" who receives the acknowledgment of receipt may request the change or cancellation of the purchase requisition upon receipt of the acknowledgment if there is discrepancy in the acknowledgment. If requested by the "Customer" before delivery, the "Member's Mall" shall process it according to the request without delay. If payment has already been made, however, it shall be subject to provisions regarding the withdrawal of subscription in Article 14.

Article 10 (Supply of Goods, etc.)

1. ① Unless there is a separate agreement regarding the supply time of goods, etc. with the "Customer,” the “Member's Mall" shall take the necessary measures such as customizing, packing, etc. so that the goods, etc. may be delivered within 7 days of the date of subscription by the "Customer.” If the "Member's Mall" has already received all or part of the payment of goods, etc., however, it shall take action within 2 business days of receiving all or part of the payment. At this time, the "Member's Mall" will take appropriate measures so that the "Customer" can check the supply procedure and progress of the goods, etc. If a separate delivery date is specified on the product page, however, the delivery will be carried out according to the indicated date.
2. ② The "Member's Mall" shall specify the means of delivery, delivery fee payer, and delivery period by each means, etc. for the goods purchased by the "Customer." If the "Member's Mall" exceeds the contracted delivery time, it shall compensate the "Customer” for any resulting damage. Note, however, that this does not apply if the "Member's Mall" proves that there was no intention or negligence.

Section 11 (Use of Service Products)

1. ① Among goods, etc. traded by the “Member's Mall,” in the case of a service product that can be received through the identity verification process at a place designated by the “Entrepreneur” after purchase, the "Customer" shall be provided with the services only within the validity period specified in the individual terms and conditions of the service product. The "Customer" cannot replace the identity verification process with email, text message, or other receipt sent to confirm the purchase of the service product. Likewise, transferring the service product to others without permission or providing it as collateral is prohibited. Note, however, that business members may be restricted from purchasing some services.
2. ② In case of failure to use the service product within the specified validity period, the "Customer" may be reimbursed in the form of points according to the policy of the "Member's Mall."
3. ③ In the case of service products covered by this article, the terms of use and refund of service products shall be determined in accordance with the policy of the entrepreneur that issued the service product. The "Customer" shall assume responsibility for checking the contents and individual precautions (conditions of use) on the "Member's Mall" and may use the services in accordance with the stipulated terms of use.

Article 12 (Discount Coupon)

1. ① Discount coupons are given for free to "Customers" participating in the event promotions of the "Owner’ Mall.” The validity period, discount amount, method of use, etc. for each discount coupon may be confirmed by individual instructions.
2. ② Discount coupons cannot be withdrawn in cash, and they may expire on their expiration date or when the contract expires.
3. ③ If the "Customer" is confirmed to have acquired or used discount coupons, etc. fraudulently, the "Member's Mall" may withdraw or cancel the discount coupon of the “Customer.”
4. ③ If the "Customer" is confirmed to have acquired or used discount coupons, etc. fraudulently, the "Member's Mall" may withdraw or cancel the discount coupon of the “Customer.”

Article 13 (Refund)

If goods, etc. purchased by the “Customer” cannot be delivered due to reasons such as out of stock, etc., the "Member's Mall" shall notify the "Customer" of the reason without delay and shall refund or take the necessary measures within 5 business days of payment if the payment of goods, etc. is made in advance.

Article 14 (Subscription Withdrawal, etc.)

1. ① A "Customer" who has entered into a contract with the "Member's Mall" for the purchase of goods, etc. may withdraw subscription within 7 days of the date of receiving the acknowledgment of receipt.
2. ② After receiving the goods, the “Customer" can neither return nor exchange them when they fall under any of the following cases:
   1. 1) If the goods are lost or damaged due to the responsibility of the “Customer” (in case of damaging the packaging, etc. in order to confirm the contents of the goods, however, the subscription can be withdrawn)
   2. 2) If the value of goods, etc. has decreased significantly due to use or consumption by the "Customer”
   3. 3) If the value of goods, etc. has decreased significantly that reselling it is difficult due to the passage of time
   4. 4) If the packaging of the original good, etc. has been damaged, and it is possible to duplicate the good, etc.
3. ③ In the case of Items 2 ~ 4, subscription withdrawal is not restricted to “Customers” if the "Member's Mall" has not specified restriction of subscription withdrawal, etc. in an easily noticeable place or has not taken any action such as providing sample products, etc.
4. ④ Notwithstanding the provisions of Clauses 1 and 2, if the content of goods, etc. is different from labeling or advertisement or executed differently from the contract, the "Customer" shall withdraw subscription within 3 months of the date of receipt or within 30 days of the date of notice.

Article 15 (Effect of Subscription Withdrawal, etc.)

1. ① If goods, etc. are returned by the "Customer," the "Member's Mall" shall refund the payment already made for the goods, etc. within 3 business days. In this case, if the "Member's Mall" delays the refund of goods, etc. to the customer, it shall pay delay interest calculated by multiplying the price by the delay interest rate determined and notified by the Fair Trade Commission.
2. ② In refunding the payment above, when the "customer" pays for the goods, etc. using payment means such as credit card or electronic money, etc., the "Member's Mall" shall immediately request the company that provides the payment method to suspend or cancel the payment for the goods, etc.
3. ③ In case of withdrawal of subscription, the "Customer" shall bear the cost of returning the goods, etc. received. The "Member's Mall" shall not charge "Customers" for penalty or damage compensation for reasons such as withdrawal of subscription, etc. If the content of goods, etc. is different from labeling or advertisement or executed differently from the contract, the "Member's Mall" shall bear the cost of returning the goods, etc.
4. ④ When the “Customer” paid the delivery fee for the goods, etc., the "Member's Mall" shall clearly indicate who is responsible for the cost when withdrawing the subscription.

Article 16 (Obligation of the Member's Mall)

1. ① The "Member's Mall" shall not engage in acts prohibited by laws and regulations or which run counter to public order and good morals but shall do its best to provide the goods continuously and reliably as stipulated by the Terms and Conditions.
2. ② The "Member's Mall" shall be equipped with a security system to protect the personal information (including credit information) of the "Customer" so that the "Customer" can use the Internet service safely.
3. ③ The "Member's Mall" shall be liable to compensate for damage caused by unfair labeling or advertisements prescribed by Article 3 of the Act on Fair Labeling and Advertising.

Article 17 (Obligation of the “Customer”)

The "Customer" shall not do the following:

1. 1. Registration of false contents when requisitioning or changing
2. 2. Illegal use of other's information
3. 3. Illegal change of information posted on the "Member's Mall"
4. 4. Sending or posting information (such as computer programs, etc.) other than those set forth by the "Member's Mall”
5. 5. Infringement of intellectual property rights of the "Member's Mall" and copyright of a third party
6. 6. Defamation of honor or obstruction of business of the "Owner's Mall" and other third parties
7. 7. Using the information of others or providing false information when requisitioning or using service
8. 8. Using the ID of a third party or making one's ID available to a third party
9. 9. Disclosing or posting pornography or violent messages, images, voices, or other information that runs counter to public morals at the Mall
10. 10. Default on the payment of goods, etc. purchased through the “Member's Mall” and “Customer's” liability in connection with the use of the “Member's Mall”
11. 11. Using services for resale purposes after purchasing products by applying coupons without any real purchasing intention

Article 18 (Relationship Between Connecting "Shopping Mall" and Non-Connecting "Shopping Mall”)

1. ① When the upper link "shopping mall" and the lower link "shopping mall" are connected by the hyperlink method (hyperlink includes text, pictures, moving images, etc.), the former is called connecting “Shopping Mall”(website), and the latter is called non-connecting “Shopping Mall”(website).
2. ② If the connecting “Shopping Mall” specified that it is not responsible for the warranty on the transactions with "customers" regarding the goods autonomously provided by the non-connecting “Shopping Mall” on its initial screen or pop-up screen during connection, the connecting “Shopping Mall” is not responsible for the warranty for the transaction.

Section 19 (Copyright Attribution and Restriction)

1. ① The copyright and other intellectual property rights of the work produced in the "Member's Mall" belong to "Member's Mall."
2. ② The “Customer” shall neither use -- nor have a third party do so -- information covered by the intellectual property of the "Member's Mall” among the information obtained by using the "Member's Mall” for commercial purposes via copying, transmission, publication, distribution, broadcasting, or other methods without the prior consent of the “Company.”
3. ③ The "Member's Mall" shall notify the "Customer" when the former uses the copyright according to the agreement.

Article 20 (Dispute Resolution)

1. ① The "Member's Mall" shall reflect the fair opinions and complaints posted by "Customers” and establish and operate the organization for compensation processing to compensate for the damage.
2. ② The "Owner's Mall" shall preferentially handle complaints and comments submitted by "Customers." If processing it promptly is difficult, however, the "Member's Mall" shall notify the "Customer" immediately of the reason and the processing schedule.
3. ③ When there is an application for damage relief by the "Customer" in relation to an e-commerce dispute between the "Member's Mall" and the "Customer,” such shall be subject to arbitration by the Fair Trade Commission or the Dispute Settlement Body commissioned by mayors and governors.

Article 21 (Privacy)

1. ① The "Owner's Mall" shall comply with the provisions of related laws and regulations, such as Act on the Promotion of Information and Communications Network Utilization and Information Protection and Personal Information Protection Act, etc., in order to protect the personal information of the "Customer." The protection and use of personal information shall be governed by related laws as well as the Privacy Policy of the "Owner's Mall."
2. ② The "Member's Mall" shall establish a Privacy Policy to protect the personal information of the "Customer" and post it on the initial screen. Note, however, that the details of the Privacy Policy can be browsed by the connection screen.
3. ③ The "Owner's Mall" shall neither use the information provided by the "Customer" for purposes other than operating the service nor provide it to a third party without the consent of the "Customer." The following cases shall be exceptions, however:
   1. 1) In cases wherein the use of member information and provision of information to a third party are permitted as per laws and regulations
   2. 2) In cases of notifying the shipping company of the minimum member information (name, address, contact number, etc.) necessary for the execution of the transaction such as delivery service, etc.
   3. 3) Others, e.g., when the consent of the “Customer” is obtained according to the terms and conditions of the “Member's Mall"
   4. 4) When necessary for the settlement of accounts due to transactions such as goods, etc.
4. ④ When it is necessary to provide and delegate the personal information of the "Customer" who purchased the "goods, etc." to the "Entrepreneur," the "Member's Mall" shall obtain consent from the "Customer.” At this time, the "Owner's Mall" shall specify to the "Customer" the personal information items provided, recipients, purpose of the recipient for using the personal information, and period of use and retention. When stipulated by the relevant laws and regulations such as Clause 1, Article 25 (Entrustment of Management of Personal Information, etc.) of the Act on the Promotion of Information and Communications Network Utilization and Information Protection, however, such shall be followed accordingly.

Article 22 (Jurisdiction and Governing Law)

1. ① Lawsuits related to e-commerce disputes between the "Member's Mall" and "Customer" shall be filed at a competent court having jurisdiction over the address of the "Company" at the time of filing.
2. ② The Korean law shall govern any and all e-commerce lawsuits filed between the "Owner's Mall" and "Customer."

Addendum

1. 1. The Terms and Conditions will be effective on August 1, 2018.
